The leader of Poland’s top conservative party, Law and Justice (PiS), is accusing the country’s main prosecutor, Adam Bodnar, of participating in a coup and threatens that if there ever is a trial, Bodnar will be one of the main defendants.
“Prosecutor General Adam Bodnar is involved in all this. If there is ever a trial, he will be one of the main defendants,” said PiS President Jarosław Kaczyński.
The accusation comes after state prosecutor, Michał Ostrowski, launched an investigation into Donald Tusk and other government officials of launching a coup.
In another interview with wPolityce, PiS MP Paweł Jabłoński stated that Donald Tusk’s government is trying to illegally change the system of government. He said it was good that the prosecutor’s office is pursuing this case after notifying the president of the Constitutional Tribunal.
“I think that sooner or later there will be criminal consequences for these people for breaking the law. If they expect to escape responsibility, they will be mistaken in this case,” said Jabłoński.
He continued by listing some of the elements of the case that he believes constitute a coup attempt.
“Certainly, the Tusk government is trying to use illegal methods to actually change the political system. We have the principle of separation and balance of powers – the executive, legislative, judicial, and the Tusk government is trying to subordinate the judicial power to political power. Government resolutions not to publish judgments or not to recognize some judges are illegal actions and these are actions that are aimed at actually changing the political system. The same should be said about taking money away from the Constitutional Tribunal and the National Council of the Judiciary. These are illegal actions that are inconsistent with the constitution, and in this way the constitutional bodies are deprived of the possibility of real action.”
However, according to the PiS MP, he believes Bodnar will work to shut the case down.
“I think that Bodnar will do everything to kill this case, take it away from prosecutor Ostrowski and perhaps give it to someone else, or even issue a supervisory decision that will lead to this case being blocked. They are very afraid of the consequences because they know that they broke the law, either by not executing the sentences or by illegally introducing their nominees to the National Prosecutor’s Office. These are illegal actions and Bodnar is, with all reservations, a good lawyer and knows perfectly well that he has broken the law many times.”
PiS leader Kaczyński also addressed that the coup is not the one seen in the typical sense, but one that is no less effective.
“We have a violation of Article 127 of the Penal Code, which is a very serious crime of changing the system by force, and this is nothing new, because I have spoken about it many times. (…) Using the term coup d’état in a broader sense is justified,” Kaczyński told journalists in the Sejm, referring to the notification of the Constitutional Tribunal president about the possibility of committing the crime of a coup d’état by the current government.
“Of course, a coup d’état in the strict sense as people imagine it, that there are tanks in the streets, shootings, etc., of course, there is none of that here, but there is a violation of the law in such a way that it can be classified under this article and it is very good that such an investigation by legal prosecutors has been undertaken because what these illegals are doing has no legal significance,” said Kaczyński.
