‘My child, this can’t be’ – An Afghan murderer avoids prison after randomly stabbing German victim Marius Dick to death, parents call CDU to cooperate with AfD to fix migration policy

"Just for the record: A state that shoves almost every foreign knife-wielding thug into a psychiatric ward instead of deporting them back to their home-country shitholes is no longer capable of delivering justice through punishment."

22-year-old Marius Dick (left) was stabbed to death in a random attack by Afghan national Sajad Mirzaee, who illegally entered Germany in 2017. Dick's family has been outspoken about the murder and the lack of punishment meted out to their son's killer.

German prosecutors will not file criminal charges against a 22-year-old Afghan man accused of stabbing a German history student to death in the city of Trier in July, arguing that a psychiatric evaluation found he was not criminally responsible when he killed the victim. The parents of the victim have spoken extensively with the media, describing their anguish over their son’s murder and calling for political change in Germany, including political cooperation with Alternative for Germany (AfD) party to protect citizens.

The Trier Public Prosecutor’s Office announced Tuesday that it had applied to the Trier Regional Court for a security proceeding aimed at permanently placing the suspect, Sajad Mirzaee, in a closed forensic psychiatric facility. They cited a preliminary expert report that diagnosed Mirzaee, who arrived in Germany in 2015 as an unaccompanied minor refugee, with a schizophrenic disorder that left him unable to control his actions, according to Welt newspaper.

The victim, 22-year-old Marius Dick, was a military history student from Landstuhl. He was murdered on July 15 on a sidewalk along Robert-Schuman-Allee. Police said the two men did not know each other before the stabbing.

Mirzaee allegedly pushed Dick from the sidewalk in a random attack and stabbed him multiple times with a large kitchen knife. During the attack, one blow struck Dick’s heart. Emergency services attempted to save Dick but he died shortly after arriving at a local hospital. Mirzaee was arrested close to the scene.

Prosecutors classified the act as manslaughter committed in a state of lack of criminal responsibility, which means Mirzaee cannot be tried in court.

The regional court must still review the placement application in a closed psychiatric facility but Mirzaee is being held provisionally in forensic psychiatry.

Even though Mirzaee’s asylum application was rejected in 2017, German authorities imposed a deportation ban to Afghanistan, which meant Mirzaee was allowed to remain in the country. Mirzaee later received a permanent residence permit in 2023, meaning he could stay in Germany indefinitely.

Dick’s parents, Elke and Thomas Dick, had previously told EuroNews in October that they did not think the suspect would be found fully responsible for the murder of their son. During the interview, Thomas Dick and his wife Elke said the family viewed the killing as murder and wanted a criminal conviction.

“It would be very unsatisfactory for us if things went in this direction and a judgment were made in this sense. This was a murder for us, and he should be convicted as a murderer,” said Elke Dick.

Notably, Elke Dick is involved with the Christian Democratic Union (CDU) party, which has been highly responsible for Germany’s immigration crisis. In fact, the migrant who murdered their son came in under Angela Merkel’s tenure in 2017 and was never deported. She stated that she received hostility for her role in the party from those who said she “deserved” what happened to her son.

The father questioned why the CDU does not at least work with the AfD on certain key issues, telling Welt: “The AfD has so many voters – they’re all supposed to be evil? We don’t talk to them? Even if we disagree, we still have to work together. You have to look for majorities to find majorities. This also means sitting down at a table with the AfD and talking about overlaps. Please do something! Anything else is a political failure.”

Elke Dick agrees, stating: “I’ve seen it that way before too: You can’t simply exclude people who were elected lawfully and in large numbers. That’s not possible; that’s against the will of the people. The politicians have sworn an oath: ‘For the good of the German people.’ People only ever talk about the AfD, but not with it.”

Elke also described the first moments of horror when she learned of her child’s death.

“Thomas was already waiting for me at the door. That was strange. When I came into the apartment, I saw the police officers and the chaplains. My husband said to me: ‘Marius is dead.’ I collapsed in front of the kitchen and all I could do was scream: ‘My child, my child, my Marius, this can’t be.’ A world collapses inside you; it tears your heart out,” she said.

A number of German commentators point to what seems to be a trend involving foreigners killing victims in Germany and then being sent to psychiatric facilities instead of prison. Columnist Anabel Schunke wrote on X about the murder: “Just for the record: A state that shoves almost every foreign knife-wielding thug into a psychiatric ward instead of deporting them back to their home-country shitholes is no longer capable of delivering justice through punishment.”

“The go-to main argument from the left is always: Yeah, but they should be tried here and serve their sentences here, otherwise they’d just pose a danger back home. But feeding these people here with our tax dollars in the loony bin even after such a bestial crime—that’s totally fine,” she continued.

Schunke noted that many of these suspects are released early, and in other cases, they are brought outside the closed psychiatric clinics for various activities, including in cases with no supervision even for murderers.

“And as for the argument that the psych ward is often worse than prison: I’d just like to remind everyone that the Somali murderer of Dr. Joachim Tüncher got unsupervised leave from the psych ward after a short time and was released after just a few years. With meds, these types get declared harmless pretty quickly. That’s not punishment. That’s a goddamn joke. Might as well just slap a postage stamp on their asses and ship them home,” she wrote.
